Welcome to Bhorus Studio. These Terms of Service (“Terms”) govern your access to and use of the websites, applications, and services provided by Bhorus Studio (“we,” “us,” or “our”), including Cracked (collectively, the “Services”). By using the Services, you agree to these Terms.
Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or legal guardian.
Your account
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Please notify us promptly if you believe your account has been compromised.
Acceptable use
You agree not to:
- Use the Services in any way that violates applicable law or regulation.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems.
- Reverse engineer, decompile, or attempt to extract the source code of our apps, except where permitted by law.
- Use the Services to harass, abuse, or harm others.
Health & fitness disclaimer
Cracked is a gamified fitness app intended for informational and motivational purposes only. It is not medical advice and is not a substitute for professional medical guidance, diagnosis, or treatment. Consult a qualified healthcare provider before beginning any new exercise program, particularly if you have a pre-existing medical condition. You assume all risk associated with physical activity you undertake while using the Services.
Subscriptions & payments
Some features of the Services may be offered on a paid or subscription basis. Where purchases are made through the Apple App Store, billing, renewals, and refunds are handled by Apple in accordance with the App Store’s terms.
Intellectual property
The Services, including all software, design, text, graphics, and the Bhorus Studio name and logo, are owned by Bhorus Studio or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use, subject to these Terms.
Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will survive.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Bhorus Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Services.
Changes to the Services or these Terms
We may modify the Services or these Terms from time to time. When we make material changes to the Terms, we will update the “Last updated” date above and, where appropriate, notify you within the Services. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of the jurisdiction in which Bhorus Studio is established, without regard to its conflict of laws principles.
